The most consequential crypto regulation bill in years is running out of runway. The CLARITY Act, formally the Digital Asset Market Clarity Act, is staring down a near-certain Senate defeat before lawmakers leave Washington for the August recess, and Bitcoin price is already absorbing the uncertainty, trading near $63,500, roughly -50% below its October 2025 all-time high of $126,200.

The central problem is blunt: Senate Republicans need 60 votes to clear a filibuster, and Democrats have not reached agreement on several unresolved provisions.

Senate Democrats have raised concerns over ethics rules, illicit finance provisions, and stablecoin yield restrictions, making the path to a successful cloture vote, the procedural motion to end debate and advance the bill, uncertain without further negotiation on those issues.

The House passed H.R. 3633 on July 17, 2025, by a 294-to-134 margin, with 78 Democrats supporting the bipartisan crypto bill. The Senate Banking Committee advanced its version on May 14, 2026, by a 15-to-9 vote, with Democrats Ruben Gallego and Angela Alsobrooks crossing the aisle, though they indicated that committee approval did not assure their support on the floor.

Senate Majority Leader John Thune mentioned that the CLARITY Act is on his pre-recess agenda, but a procedural vote is uncertain, with the next chance for a floor vote likely in mid-September.

This is due to government funding discussions and upcoming midterm elections. Senator Cynthia Lummis confirmed a floor vote is anticipated, highlighting that Democratic compromises, including ethics provisions for federal officials, have influenced the bill’s text.

Currently, Polymarket estimates the probability of the CLARITY Act passing in 2026 at 31%, dropping 9 points in the past month. Coinbase CEO Brian Armstrong and Grayscale are pushing for an immediate Senate vote, with backing from firms like BlackRock, Fidelity, and Goldman Sachs, who see it as crucial for U.S. crypto market structure.

If a vote doesn’t happen, Bernstein suggests that the SEC and CFTC might expedite rulemaking under Project Crypto to create a framework for digital assets, though this approach is slower and less effective than new legislation.

Inaction on the bill won’t make crypto assets illegal, but it will perpetuate a chaotic regulatory environment. If no vote occurs in August, comprehensive regulations for the $2.28 trillion industry could be delayed until 2027, risking a very different Congressional landscape.
